1. What Health Stacked is
Health Stacked is a platform for discovering and shopping vetted health products. We also provide tools for health practitioners and enthusiasts to build shareable product recommendation pages. We are not a medical provider, and nothing on this platform constitutes medical advice.
2. Not medical advice
Nothing on Health Stacked — including product listings, AI recommendations, or creator stack pages — constitutes medical advice. Always consult a qualified healthcare provider before making health decisions or changing your routine based on products found on this platform.
3. Products and availability
Health Stacked does not sell, ship, or fulfill products. All purchases are made directly with the product brand or retailer. We are not responsible for product quality, accuracy of product descriptions, shipping times, returns, or disputes between you and a product brand. Product listings, screening information, and availability may change without notice.
4. Using the catalog and AI recommendations
Health Stacked provides a curated catalog of health products for informational purposes. Product descriptions and toxin screening information are provided to help you make informed decisions. We do not guarantee the accuracy of any product information. Always verify details directly with the brand before purchasing.
For creators
5. Creator responsibilities
If you create a stack page, you are responsible for the products you recommend and the claims you make about them. You must not present your stack as medical advice or imply that any product can diagnose, treat, cure, or prevent any disease. You must comply with the FTC Endorsement Guides (16 CFR Part 255), including clear and conspicuous disclosure of any material connection to a brand — whether that's a paid sponsorship, a free product received, or an affiliate commission. If you are a licensed professional, you are responsible for complying with any applicable rules of your licensing board.
6. Custom links and affiliate relationships
Health Stacked allows you to add custom product links, including your own affiliate links. Any affiliate relationships you maintain are between you and the brand or affiliate network — Health Stacked does not manage, track, or take a cut of your affiliate revenue. You are responsible for complying with FTC disclosure requirements and any terms set by your affiliate programs.
7. Your content and profile
By creating a stack page, you grant Health Stacked a non-exclusive, royalty-free license to display your profile, bio, and product recommendations publicly on our platform and in promotional materials. You retain ownership of your content. You can delete your account at any time, which will remove your public profile.
7a. Intellectual property complaints
If you believe content on Health Stacked infringes your copyright, trademark, or other intellectual property rights, email us at aastha@healthstacked.com with (a) a description of the allegedly infringing content and its location on the platform, (b) proof of your ownership or authorization to act on behalf of the owner, (c) your contact information, and (d) a statement that your complaint is made in good faith. We will respond to valid complaints promptly and may remove content pending investigation.
8. Account termination
Health Stacked reserves the right to suspend or terminate accounts that violate these terms, post misleading health claims, engage in spam or fraudulent activity, or otherwise harm our platform or users. We will try to give you notice before termination unless the violation is severe.
9. Limitation of liability
Health Stacked is provided “as is” and “as available.” To the fullest extent permitted by applicable law, Health Stacked and its officers, employees, and agents disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Health Stacked's total liability to you for any and all claims arising out of or relating to your use of the platform exceed one hundred U.S. dollars ($100) or the amount you paid us in the twelve months preceding the claim, whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
9a. Indemnification
You agree to indemnify and hold harmless Health Stacked and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the platform, (b) your violation of these terms, (c) your violation of any law or the rights of any third party, or (d) any content, product recommendation, or claim you make through the platform.
10. Changes to these terms
We may update these terms from time to time. We'll notify you of significant changes via email or a notice on the platform. Continued use of Health Stacked after changes take effect constitutes acceptance of the new terms.
11. Governing law and dispute resolution
These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or relating to these terms or your use of Health Stacked will be resolved through binding individual arbitration administered by JAMS or the American Arbitration Association under the rules then in effect. Arbitration will take place in Missoula, Montana, or by video conference if you prefer. You waive the right to participate in class, collective, or representative actions. Either party may bring small claims actions in their local jurisdiction for disputes under $10,000. Notwithstanding this section, either party may seek injunctive or equitable relief in court to protect intellectual property rights or confidential information.
